నెదర్లాండ్స్ కుటుంబ ఆస్తి విభాగాన్ని అర్థం చేసుకోవడం
Dutch divorce law does not divide everything in half as a matter of course, and which rules apply depends on when you married.
For marriages entered into on or after 1 January 2018 the default regime is the limited community of property. What each spouse owned before the marriage remains theirs, as do gifts and inheritances received at any time; what is built up during the marriage is shared, as are the debts incurred during it. For marriages entered into before that date the default is the general community of property, in which in principle everything falls into the joint estate regardless of when or how it was acquired, unless an exclusion clause was attached to a gift or inheritance. Where prenuptial or postnuptial conditions were drawn up, they displace the default altogether — and the most frequent source of dispute is a periodic set-off clause that the couple never actually performed, because Article 1:141 of the Civil Code then presumes that all assets present at the end of the marriage are to be set off.
The community dissolves on the day the divorce petition is filed, and that day is the reference point for what falls in. Each spouse is in principle entitled to half; departure from equal shares is permitted only in highly exceptional circumstances. Pension accrued during the marriage is dealt with separately under the Pension Rights (Equalisation on Divorce) Act, which requires the pension provider to be notified within two years of the divorce if payment is to be made directly to the former spouse.
This article explains what falls in and what stays out, how a business, a home bought partly with inherited money and pension entitlements are treated, and the choices open to you when negotiating a settlement.
